Health Guarantee
This contract is written for the protection of the breeder, the buyer and the
puppy. The puppy is defined to be an American Cocker Spaniel puppy and
embodies the characteristics of the American Cocker Spaniel Breed.
Puppy is in excellent Health at this time. Seller warrants that every precaution
has been taken and quality care to insure the physical soundness and mental
stability of this puppy to date. Puppy is active, eating well and has normal
stools. The puppy will have started its first set of shots/de-worming. But,
puppy is not fully protected until it receives all boosters/repeat de-worming.
It is the sole responsibility of Buyer to continue such to completion. Viral
areas and worming can become an issue when puppy is under stress/public
exposure.... Seller is not responsible for any vet expenses for such at
anytime ; or does not assume any liability for injury or illness to the said
puppy after the date of sale or shipping.
Buyers should have puppy examined by Vet as a further precaution along with
stool sample within 72 hours time of purchase/pick-up. Buyer's Care
Requirements: Buyer agrees to care for this puppy.
This includes; but is not
limited to:
A. Maintaining the puppy on a proper puppy diet at a weight sensible for its
age/size.
B. Giving the puppy regular care, grooming, exercise, and provide veterinary
care including
checkups, hear-worm preventative, vaccinations, de-worming. (An annual check up
is
advised.)
C. Confining the puppy to a suitably fenced area, neither chaining it nor
allowing it to
roam free.
D. Giving puppy/adult warm temperature of 70 degree's w/ shelter from
sun/snow...
Health Guarantee 1 Year: If w/ in 1 years time from puppy's 1st.birthday is
found to have a life threatening congenital defect on major organs that prevents
puppy from action as a pet/companion...Have your vet document this condition w/
a signed written statement. Then a Replacement Puppy @ equal value will be given
upon availability. * In event of death an autopsy must be obtained to establish
cause. We require the return of the defective puppy unless otherwise stated by
Seller.
Puppy must also be in good clean condition as when it left the seller. All
current vaccinations/de-worming are required along w/ healthy diet. Replacement
Puppy an/or returned funds are based on clearing of the buyers method of payment
and return of the original puppy to the Seller. The Seller shall not be liable
for any damages or any claim(s) arising in any event, punitive, consequential,
or accidental. IF AFTER examination by
Breeders vet a puppy is found to not be in perfect health and you have a deposit
on said puppy, breeder/Seller will apply your deposit to a
similar puppy of color/sex.. If this is not acceptable to buyer
the deposit will be forfeited to breeder/Seller.
Outside of this Health Guarantee "Puppy is sold in an AS IS condition".
Deposits: Half of full purchase price is required for down payment and remaining
balance is due at puppy pickup. Deposit is for the purpose to hold the puppy
until pick up day. Deposits are non-refundable. The date of pick up
is determined by the breeder when breeder determines the puppy is ready to go
and you are notified. It can be negotiated at that point if that day
is inconvient , But if must be agreed upon in writing by the
breeder/seller . If for ANY reason the Buyer does not complete the
purchase before the puppy is 8 weeks of age, all money placed on the puppy
will not be refunded and will be forfeited to the Breeder/Seller. If
the puppy is to be shipped, all fees need to be paid in full at or before
the puppy is 8 weeks old so shipping arrangements can be made. If for
ANY reason shipping charges are not paid in full by 8 weeks , buyer
forfeits the puppy to the breeder/ Seller and there will be no refunds.
Kennel Boarding: We "Hold" a puppy after pick up day for 7 days to give time for
buyer to pick up. Beyond that time we will need to charge a Boarding fee if
puppy is not picked up within the 7 days. We charge $15.00 per day. Days would
be assessed starting after the 7th day, pick up allowance.
Seller is not responsible for any vets bills whatsoever at anytime after puppy
leaves our premises for routine or emergency care.
Seller is not responsible for any future problems of puppy developed after
leaving premises that could be related to accident, over heat/cold exposure,
repeat exposure to chemicals used for upholstery cleaners, house cleaners, lawn
fertilizers, air fresheners, viral, bacterial, long term poor diet....
Payments in Full: The purchase price must be paid in full before delivery of the
puppy. If not otherwise specified, the seller requires balance be made in cash
on pick up date when puppy is picked up here.
Size: Breeder cannot guarantee exact size. Although, the Seller has attempted to
grade/evaluate the litter for certain expectations, such is made as an educated
guess at best and based on reasonable assumptions. Considering bloodline, and
other factors. The Seller cannot guarantee the future weight of a puppy
especially so w/ spay/neutering which increases weight size. Buyer further
recognizes that the seller/breeder makes NO warranties regarding what
color, condition or temperament the offspring of this puppy will or can
produce.
Buyer acknowledges:
Any issues that could be a result of injury from dropping, squeezing, rough
play, stress related from other pets can cause havoc on puppy's health. Seller
is not responsible for any vet bills w/ this in mind. Seller is not
responsible if the puppy is injured, lost , stolen, killed or occurs
health problems during shipping if shipping
is required.
Both Seller and Buyer have read the terms here; understand and agree to Sales
Contract.
Buyer has Instructions, read and understand puppy's care.
